When the Jumbunna decision was issued, the doctrine of intergovernmental immunities prevented the Commonwealth Court of Conciliation and Arbitration from exercising jurisdiction over State instrumentalities or authorities and their employees. The High Court abandons this doctrine in the Engineers' Case.
